  1. INTRODUCTION AND SCOPE

ScholarOne is a software solution provided by Silverchair to customers, namely scholarly publishers and societies (in this Notice, “Publisher”).

Your personal data in ScholarOne is under the control of each Publisher. Silverchair acts as a data “processor”, handling your data in ScholarOne according to the instructions of the Publisher. Personal data is any information that does, or could, identify you.

This Privacy Notice is provided by Silverchair and describes ScholarOne’s role in the collection, use, transfer, security, and eventual disposal (collectively “processing”) of your personal data. To gain a full insight into how your data is processed, you should additionally consult the Publisher’s privacy notice or contact the Publisher directly.

Throughout this notice, “Silverchair”, “we”, “us” or “our” means all the businesses of Silverchair, including its affiliates.

  1. CHANGES TO THIS NOTICE

We will update this Notice from time to time and will communicate material changes to you by the best means available to us (for example, by a prominent notice in the ScholarOne user interface).

  1. PERSONAL DATA COLLECTED

ScholarOne holds the following personal data:

  • Personal data that you provide to Publishers when you create and use an account, for example, your contact information and details about your academic or scholarly résumé including affiliations and areas of expertise.
  • Special category data including race, gender and ethnicity for the Publisher’s diversity, equity and inclusion (DEI) reporting. Providing this data is optional and will only be used for the Publisher’s DEI reporting. If you choose not to provide this information, it will have no effect on your ability to use ScholarOne.
  • Data that other ScholarOne users may input to create an account for you when you have co-authored a manuscript with them or they are interested in your taking part in the peer review process. ScholarOne uses “Reviewer Locator” functionality under an alliance agreement with Clarivate which assists Publishers to find potential reviewers from Clarivate’s Web of Science database. Reviewer Locator and Web of Science are governed by the Clarivate Privacy Policy available at https://clarivate.com/privacy-center/.
  • Like most web-based services, ScholarOne uses standard technologies such as web server logs and cookies to collect information about how end-users use the service. We use these technologies to save individual user configurations and preferences, and for troubleshooting and product development purposes.
  • Silverchair also deploys third-party product analytics and user engagement tools on ScholarOne for Silverchair’s own product improvement, service optimization, and user experience purposes. These tools may appear as in-app elements (such as pop-up prompts, feedback widgets, or satisfaction surveys) and may collect information about your interactions with ScholarOne, including pages visited, features used, clicks and navigation patterns, responses to in-app surveys or feedback prompts, and satisfaction ratings. Where enabled, these tools may also record user sessions (for example, visual replays of how you navigate the platform) to help Silverchair identify usability issues and improve the user experience; session recordings are subject to technical controls designed to mask or exclude sensitive input fields. Silverchair does not use these tools for advertising, marketing, or user tracking purposes. These tools are classified as performance cookies and can be disabled through the Cookie Settings link in the footer of each ScholarOne page. A current list of Silverchair’s sub-processors, including third-party analytics providers, is available at silverchair.com/legal/subprocessors.
  • Publishers may choose to deploy additional third-party tools on their ScholarOne sites (for example, via tag management services) that use cookies or similar technologies for purposes such as analytics, user engagement, or personalization. These tools operate under the Publisher’s direction and are subject to the Publisher’s own privacy notice and cookie policy. Where such tools are active, you may manage your preferences through the cookie consent mechanism on the applicable ScholarOne site. For more information about any Publisher-deployed tools, please consult the Publisher’s privacy notice.
  1. PURPOSES OF PROCESSING
  • Silverchair processes your personal data in ScholarOne to provide our services to the Publishers.
  • In addition, Silverchair uses web server logs, cookies, and third-party product analytics and user engagement tools for the following purposes related to Silverchair’s operation and improvement of the ScholarOne platform:
    • product improvement, troubleshooting, and service optimization;
    • understanding how users interact with ScholarOne features and functionality;
    • conducting user experience research, including through session replay recordings where enabled;
    • collecting user feedback through in-app prompts, satisfaction surveys, and similar engagement tools; and
    • generating anonymized and aggregated insights about platform usage and user satisfaction that may be shared with Publishers to help them understand how their ScholarOne sites are used.
  • Silverchair does not use your personal data collected through these tools for advertising or marketing purposes. Where Silverchair shares usage insights with Publishers, such insights are provided in anonymized and aggregated form and do not identify individual users.
  • Publishers use ScholarOne to manage their workflow with you, for example to give you access to their ScholarOne site, and send you e-mails relating to your reviewing and editing activities.
  • Publishers may choose to activate a ScholarOne tool that helps detect fake peer reviews, in part through the processing of personal data, for example e-mail addresses and submission statistics.
  • Publishers may use your ScholarOne contact information to send you marketing communications. Each Publisher is responsible for obtaining your consent, if required, to send you marketing communications and for managing your marketing preferences.
  • Publishers may deploy third-party analytics, personalization, or engagement tools on their ScholarOne sites. Where such tools process your personal data, the Publisher is responsible for ensuring an appropriate legal basis exists for that processing, including obtaining your consent where required. You may manage your preferences through the cookie consent mechanism on the applicable ScholarOne site.
  • Publishers may use the special category data you provide for DEI reporting. They will not use your special category data for any other purpose.
  • You should consult the Publisher’s privacy notice for a full understanding of how each Publisher uses your ScholarOne personal data.
  • EU GDPR ARTICLE 6 (LAWFULNESS OF PROCESSING) INFORMATION: As data controller, each Publisher determines the legal basis upon which it processes the personal data of European individuals. These bases may include your consent and the necessity of fulfilling a contract with you. To the extent Silverchair processes personal data as a controller for its own product improvement and analytics purposes as described above, Silverchair’s legal basis is its legitimate interest in improving and optimizing the ScholarOne platform, balanced against your rights and interests. Where required by applicable law (for example, for the use of non-essential cookies or session replay technologies), Silverchair will obtain your consent through the cookie consent mechanism on the applicable ScholarOne site.
  1. RECIPIENTS OF THE DATA

Your personal data in ScholarOne will be accessed by:

  • Silverchair employees and contractors whose roles require access to your data. Our personnel are bound to confidentiality terms which cover their obligations to protect personal data.
  • Silverchair suppliers who process personal data on our behalf (“sub-processors”); for example, ScholarOne is hosted on third-party servers, and Silverchair uses third-party product analytics and user engagement tools as described in Section 3 above. Silverchair suppliers are contractually bound to protect your data to the same standard as set out in this Notice, including through data processing agreements that impose appropriate data protection obligations. A current list of Silverchair’s sub-processors is available at silverchair.com/legal/subprocessors.
  • Third-party service providers deployed by Publishers on their ScholarOne sites at the Publisher’s direction. These providers may collect personal data (such as user identifiers, login activity, or usage data) for purposes determined by the Publisher, including analytics and personalization. Silverchair facilitates these deployments on the Publisher’s instruction but does not control the data collected by these tools. For details on any third-party tools active on a Publisher’s ScholarOne site, please consult the Publisher’s privacy notice.
  • The Publishers that are the “controllers” of your personal data and who may disclose your data to other organizations and individuals.
  • Silverchair may share anonymized and aggregated insights derived from its product analytics and user engagement tools with Publishers to help them understand how their ScholarOne sites are used. These insights do not contain personal data and cannot be used to identify individual users.
  • Your data may be transferred to a third party as a result of any merger, acquisition, or similar corporate event involving Silverchair.
  • We will disclose your personal data when required to by law.
  1. DATA SECURITY

Silverchair maintains appropriate administrative, technical, and physical security measures to protect your personal data from accidental loss and unauthorized access or use. These measures include encryption, firewalls, roles-based data access, intrusion-detection software, and physical access controls to data centers. However, we cannot guarantee that loss, misuse, unauthorized acquisition, or alteration of your data will never occur.

  1. DATA RETENTION

The period for which your data will be retained will be set by the policies of each Publisher. Silverchair will retain your data in ScholarOne until the Publisher is no longer a customer, or upon request.

  1. INTERNATIONAL TRANSFER

ScholarOne is hosted on servers in the United States.

We protect our transfers from the United Kingdom and the European Economic Area with approved legal safeguards that may include:

  • the existence of a European Commission adequacy decision (covering, for example, transfers to Canada, New Zealand, and Switzerland);
  • Standard Contractual Clauses approved by the European Commission (“Standard Contractual Clauses”) and, if applicable, the United Kingdom Addendum approved by the UK Information Commissioner’s Office and other contract terms executed between Silverchair and applicable third parties that ensure personal data remains protected in accordance with applicable law; or
  • the existence of binding corporate rules or other certification mechanism approved by applicable law.
  1. YOUR RIGHTS AND CHOICES

If you have questions about how the Publisher processes your personal data or want to submit a data subject request relating to Publisher-controlled data, you should contact the Publisher. If you have questions about Silverchair’s processing of your personal data for product improvement and analytics purposes as described in this Notice, or if you wish to exercise your data protection rights in relation to such processing, you may contact our Privacy Office at dataprivacy@silverchair.com. You may also manage your cookie preferences, including disabling performance cookies used by Silverchair’s analytics tools, through the Cookie Settings link in the footer of each ScholarOne page.
